Court Sends Transgender Women Case Back to Tribunal

A federal court reversed an earlier ruling against a lesbian action group. The tribunal had decided the Lesbian Action Group could not exclude transgender women. Now the case returns to the administrative tribunal for further examination.

The Lesbian Action Group opposed the earlier ruling. The group claims the right to set participation criteria for events. The tribunal ruled against this, but the federal court decided this case is more complex.

This issue has existed longer in Australia. It concerns fundamental questions: what rights do organisations have? How do you balance membership rights against anti-discrimination laws? The tribunal will now reconsider the case.

This is not a final end to the dispute. Both parties can present their positions again. The tribunal must determine if the group can exclude transgender women, or this violates anti-discrimination laws.
